The State of California’s Proposition 65 is a consumer-protection law that requires providing warning notice of chemicals that cause cancer. “Wood dust” has recently been added to the Proposition 65 law, triggering a duty for manufacturers, distributors, and sellers of wood products to provide clear and reasonable warnings about wood dust to California consumers.  This letter is to notify you, and to enlist you as a member of the notification team, that use of wood products may result in exposure to wood dust, which is known to the State of California to cause cancer.

Both you and LP must comply with the warning notice requirement, as well as any downstream buyers of the product you are purchasing from us.  This requirement will apply to shipments of product that have any possibility of being sold, either in whole or in part, in California. To advance the process of notifying downstream buyers of LP wood products, LP is providing you with a sample warning sign, included with this letter.  Beginning December 18, 2010, all distributors or sellers of LP wood products, whether wholesalers or California-based retailers, must ensure that end-users see this notice prior to purchase.  The sign should not be reduced in size and should be posted conspicuously at either the product display or point of sale.

The State of California is also requiring manufacturers such as LP to get confirmation in writing that its customers understand and agree to implement the warning notice program.
